Terms & Conditions
These Terms and Conditions apply to quotations, orders and services supplied by Electric Gates Glasgow, a trading name of Electric Gates Experts.
They cover electric gate installation, automation, repairs, maintenance, access control, fabrication and related work.
Please read these Terms alongside your quotation, order confirmation, Cancellation and Refund Policy and Privacy Policy. Nothing in these Terms limits your statutory rights as a consumer.
1. About Us
In these Terms, “we”, “us” and “our” refer to Electric Gates Glasgow, a trading name of Electric Gates Experts.
“You” and “your” refer to the customer named on the quotation, order confirmation or invoice.
Our contact details appear at the end of these Terms.
2. Quotations
Unless stated otherwise, our quotations are valid for 30 days from the date shown.
A quotation is based on the information available at the time, including site conditions visible during the survey. It may be revised if:

Measurements or project requirements change

Hidden ground or structural conditions are discovered

Existing gates, posts, cabling or foundations require additional work
-
The customer requests different materials, equipment or access controls
-
Supplier or manufacturer prices change before the order is accepted
-
Planning, access or safety requirements affect the proposed design
Prices displayed on our website are indicative unless expressly confirmed in a written quotation.
The quotation will state whether VAT is included or charged separately.
3. Forming the Contract
A contract is formed when we confirm your order in writing, accept the required deposit or begin work with your agreement.
The contract consists of:

Any approved drawings or specifications

The order confirmation

Any written variation agreed after the order
If there is a conflict, the accepted quotation or written variation will take priority for the specific project.
4. Bespoke Designs and Customer Approval
Many gates are designed and manufactured specifically for an individual property.
You are responsible for checking and approving applicable drawings, measurements, colours, finishes, access-control options and design details before fabrication begins.
We are not responsible for a design choice that you approved unless the finished work does not materially match the agreed specification or we failed to exercise reasonable care and skill.
Small variations in colour, grain, texture, welding or finish may occur due to the nature of timber, steel, aluminium and other materials. These will not be treated as defects where they are within normal manufacturing tolerances and do not affect operation or safety.
5. Deposits and Payments
The required deposit and payment schedule will be shown in your quotation or order confirmation.
Deposits may be used to reserve installation time, complete design work, order equipment and purchase or manufacture bespoke materials.
Stage payments and final balances must be paid by the dates shown on the quotation or invoice.
If an undisputed payment becomes overdue, we may:

Pause work until payment is received

Delay ordering materials or equipment
-
Reschedule the installation
-
Recover reasonable costs incurred in collecting the overdue amount where legally permitted
Pausing work due to an overdue payment may affect the anticipated completion date.
6. Cancellations and Refunds
Your cancellation rights depend on how the contract was agreed, whether work has started and whether goods are bespoke or made to your specifications.
Details are provided in our Cancellation and Refund Policy.
If you ask us to begin design, ordering, fabrication or installation during a statutory cancellation period, you may be required to pay for work completed and reasonable costs already incurred.
Bespoke or clearly personalised goods may not qualify for ordinary change-of-mind cancellation rights.
Any amount retained following cancellation will reflect work completed and reasonable losses that cannot be avoided. Deposits are not automatically treated as non-refundable in every circumstance.
7. Installation Dates and Delays
Any survey, manufacturing or installation date is an estimate unless we expressly confirm in writing that it is guaranteed.
Projects may be affected by:

Adverse weather
-
Supplier or manufacturer delays
-
Material shortages
-
Unforeseen ground or structural conditions
-
Planning or building-control requirements
-
Delays caused by utilities or other contractors
-
Restricted site access
-
Events outside our reasonable control
We will keep you reasonably informed of significant delays and arrange a revised date.
We will still perform our services within a reasonable time as required by applicable consumer law.
8. Site Access and Customer Responsibilities
You must provide safe and reasonable access to the property at the agreed times.
You must also:

Tell us about known underground services, drains, cables, pipes or other hazards
-
Keep the working area reasonably clear
-
Keep children, pets and unauthorised people away from the working area
-
Provide access to an appropriate electricity supply where required
-
Inform us of site restrictions, parking restrictions or access limitations
-
Obtain landlord, factor or third-party consent where required
-
Tell us about any known boundary disputes or shared access arrangements
-
Avoid instructing other contractors to interfere with our work without agreement
Additional work caused by inaccurate information, undisclosed hazards, restricted access or interference by others may be chargeable following discussion with you.
9. Planning Permission and Other Approvals
Unless expressly included in the quotation, you are responsible for obtaining any necessary planning permission, listed-building consent, landlord approval, factor approval or other authorisation.
We may provide general information based on our experience, but this does not constitute legal or planning advice.
We are not responsible for decisions made by a council, planning authority, landlord, factor or other third party.
10. Existing Gates and Equipment
Automation of existing gates is subject to the gates, posts, hinges, foundations and surrounding structure being suitable.
Some defects cannot be identified until equipment is opened, tested or dismantled.
If we discover hidden deterioration, unsafe construction or unsuitable equipment, we will explain the problem and any additional work required. We will obtain your agreement before completing material additional work, except where immediate action is reasonably required to leave the site safe.
We cannot guarantee compatibility with equipment, software or components that were not supplied by us.
11. Changes and Additional Work
Changes to the agreed scope must be approved by both parties.
Where possible, we will confirm:

The requested change

Additional or reduced cost
-
Effect on manufacturing
-
Effect on the installation date
-
Any change to warranty coverage
Minor emergency or safety work may be completed without prior written approval where it is reasonably necessary to prevent immediate danger or property damage. We will explain the action taken as soon as possible.
12. Completion and Handover
Work will be considered complete when the system has been installed, tested and made available for normal use, subject to any agreed minor outstanding items.
At handover, we may provide operating instructions, manual-release information and relevant equipment documentation.
You are responsible for ensuring that authorised users understand how to operate the gate and manual-release system safely.
Minor snagging items will be addressed within a reasonable time. Amounts not reasonably in dispute remain payable in accordance with the agreed payment schedule.
13. Workmanship Warranty
Our workmanship warranty begins on the date of completion or commissioning.
Unless a longer period is stated in your quotation, the workmanship warranty periods are:

Electrical installation: 2 years

Gate automation installation: 2 years
-
Access-control installation: 2 years
-
Steel fabrication: 5 years
The workmanship warranty covers faults caused by defective installation or fabrication completed by us.
Where a valid workmanship claim is established, we will repair or repeat the affected work within a reasonable time and without charge.
This warranty is in addition to, and does not replace, your statutory rights.
14. Equipment and Manufacturer Warranties
Motors, control panels, intercoms, keypads, safety equipment and other products may also be covered by a manufacturer’s warranty.
Manufacturer warranty periods and conditions vary between products.
We will provide reasonable assistance with a manufacturer claim for equipment supplied by us. A manufacturer’s warranty is additional to your statutory rights against us as the supplier.
Where consumer law requires us to repair or replace faulty goods, legally required labour, removal, refitting and related costs will not be charged to you.
Where a claim falls only under an additional manufacturer warranty and not under your statutory rights or our workmanship warranty, associated labour, travel, access equipment or recommissioning may be chargeable. We will tell you about applicable charges before carrying out the work.
15. Warranty Exclusions
A warranty may not cover a fault to the extent that it was caused or materially contributed to by:

Normal wear and tear
-
Misuse, neglect or accidental damage
-
Vehicle impact, vandalism or attempted forced entry
-
Flooding, lightning, power surges or unsuitable power supplies
-
Vermin, severe corrosion or environmental conditions outside the equipment specification
-
Work, alteration or programming completed by an unauthorised third party
-
Failure to follow operating or maintenance instructions
-
Obstruction of gate movement
-
Consumable items such as batteries where normal depletion has occurred
-
Failure of third-party internet, mobile or telephone services
-
A pre-existing defect in gates or structures not supplied by us
A lack of servicing will only affect a claim where the absence of appropriate maintenance caused or contributed to the reported fault.
These exclusions do not remove rights that cannot legally be excluded.
16. Reporting a Fault or Warranty Claim
Please report a fault promptly and provide:

Your name and site address
-
Quotation or invoice number, if available
-
Description of the problem
-
Photographs or video where helpful
-
Details of any recent damage, power failure or third-party work
You must give us reasonable access to inspect and diagnose the system.
If the issue is covered by our workmanship warranty or your statutory rights, we will arrange the appropriate remedy.
If no covered fault is found, or the problem falls outside the warranty, our normal call-out and labour charges may apply. We will explain any charge before completing non-emergency work.
17. Repairs and Maintenance
Repair and maintenance charges will be explained when the appointment is booked or confirmed.
A repair quotation may be subject to further investigation if the complete cause of the fault cannot be established during the initial inspection.
Replacement parts may differ from the original where the original component is obsolete or unavailable. Any alternative will be selected for appropriate compatibility and discussed with you where the difference is material.
Regular servicing is recommended to support safe and reliable operation, but it does not guarantee that a component will never fail.
18. Safety and Manual Release
Automated gates contain moving electrical and mechanical components. They must be operated in accordance with the instructions provided.
Safety devices must not be removed, bypassed, obstructed or deliberately disabled.
You must contact us if the gate behaves unexpectedly, reverses without cause, strikes an obstruction or appears unsafe.
Stop using the automatic system if continued operation could create a danger.
Manual-release equipment should be kept accessible to authorised users.
19. Liability
We are responsible for losses that are a reasonably foreseeable result of our breach of contract or failure to exercise reasonable care and skill.
We are not responsible for losses caused by:

Inaccurate information provided by you
-
Unauthorised third-party work
-
Your failure to follow operating or safety instructions
-
Events outside our reasonable control
-
Failure of third-party internet, telephone, mobile or utility services
We do not exclude or limit liability where it would be unlawful, including liability for:

Death or personal injury caused by negligence
-
Fraud or fraudulent misrepresentation
-
Breach of statutory consumer rights
-
Any other liability that cannot legally be excluded
If you are a consumer, we are not responsible for business losses arising from work supplied primarily for domestic or private use.
20. Events Outside Our Control
We will not be responsible for delay or failure caused by an event outside our reasonable control.
We will take reasonable steps to reduce the effect of the event and resume work when reasonably possible.
If the delay becomes substantial, either party may discuss cancellation. Any refund will take account of goods and services already supplied and will comply with applicable law.
