These Terms and Conditions ("Terms") govern your use of the services provided by Electric Gates Glasgow, including but not limited to the installation, maintenance, and repair of electrical gates ("Services"), as well as your access to and use of the Electric Gates Glasgow website ("Website"). By accessing the Website or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or our Services.
1. Service Agreement:
- By engaging Electric Gates Glasgow for any Services, you agree to abide by the terms outlined in the service agreement provided by Electric Gates Glasgow.
2. Payment:
- Payment for Services is due upon completion unless otherwise agreed upon in writing. Failure to pay may result in additional fees or suspension of Services.
- Prices listed on the Website are subject to change without notice. Please confirm current pricing before proceeding with any Services.
3. Liability:
- Electric Gates Glasgow shall not be liable for any damages, including but not limited to direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our Services or Website.
- We do not guarantee the security, reliability, or accuracy of information transmitted through our Website or during the provision of Services.
4. Installation and Manufacturer Warranties:
4.1 Installation Warranty
We stand behind our workmanship. The installation warranty covers defects in our installation work (not the parts themselves) from the date of completion/commissioning for the periods below:
- Electrical: 2 years installation warranty.
- Automation: 2 years installation warranty.
- Access Controls: 2 years installation warranty.
- Steel Fabrication: 5 years installation warranty.
What this covers:
- Repair or re-performance of our installation work where a defect arises due to our workmanship.
- Reasonable labour and materials to correct our workmanship issues.
What this does not cover:
- Faults caused by the parts/products themselves, normal wear and tear, misuse, neglect, accidental damage, power surges, vermin, weather or environmental conditions beyond specification, corrosion due to site conditions, or third‑party modifications/works.
- Software/firmware updates or configuration changes outside the original scope.
- Finishes and coatings (e.g., paint, powder coat) unless expressly included; cosmetic issues that do not affect function.
- Any issue arising where the system has not been used, maintained, or serviced in line with our instructions/manufacturer guidance.
Conditions:
- The installation must not be altered by others without our prior written consent.
- The system must be operated and maintained as instructed, and all invoices must be paid in full.
- You must provide reasonable access for inspection and remedial works.
Our sole obligation under this installation warranty is, at our option, to repair or re-perform the defective installation work. We may charge for call-outs where no defect in our workmanship is found.
4.2 Manufacturer’s Warranty (Parts Only)
All parts and equipment we supply are covered by the manufacturer’s own warranty terms. The manufacturer’s warranty:
- Is specified by the manufacturer of the parts we install.
- Covers replacement parts if applicable.
- Does not cover the labour costs associated with diagnosing, removing, refitting, reprogramming, commissioning, or otherwise attending to replacement parts.
- May require product registration, proof of purchase, proper maintenance, and compliance with usage instructions.
- Is subject to the manufacturer’s exclusions and claim procedures, which may vary by product and brand.
We’ll assist in facilitating a manufacturer's claim where reasonable, but approval, timing, and scope are determined solely by the manufacturer. Any labour, access equipment, shipping, travel, testing, or recommissioning related to manufacturer part replacement is chargeable unless expressly agreed otherwise.
4.3 Claims, Exclusions, and Process
How to make a claim:
1. Notify us promptly with your order details, site address, a description of the issue, and supporting photos/videos where possible.
2. Allow us access to inspect, test, and diagnose the issue.
3. If it is an installation workmanship defect within the relevant warranty period, we will arrange remedial works at our cost as outlined above.
4. If the issue is a faulty part covered by a manufacturer’s warranty, we will help you pursue the parts replacement under the manufacturer’s process. Labour and associated costs are chargeable.
5. If no fault is found or the issue is outside warranty, standard call-out, labour, and material rates apply.
General exclusions and limits:
- This clause does not affect your statutory rights.
- Warranties are non-transferable unless we agree in writing.
- We are not responsible for loss of data, software configurations, or consequential, indirect, or special losses.
- Any timelines for attendance are subject to parts availability, manufacturer response times, and site access.
5. Intellectual Property:
- All content and materials on the Website, including but not limited to text, graphics, logos, images, and software, are the property of Electric Gates Glasgow and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Website without prior written permission.
6. Privacy:
- Electric Gates Glasgow respects your privacy and is committed to protecting your personal information. Please review our Privacy Policy to understand how we collect, use, and disclose your information.
7. Governing Law:
- These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in Scotland.
8. Modifications:
- Electric Gates Glasgow reserves the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website. It is your responsibility to review these Terms periodically for updates.
